ATTORNEY GENERAL SALAZAR REPORTS ON NO-CALL ENFORCEMENT
Denver--Attorney General Ken Salazar today released information on No-Call enforcement activities in January. The official No-Call list, effective February 1, now contains 1,069,082 residential numbers. This represents more than half of the residential phone lines in Colorado. In January, the Attorney General's Office issued 14 cease-and-desist notices, thirteen to out-of-state companies and one to a Colorado business. A list of these companies is attached. The Attorney General's Office also took enforcement action against one local company that had previously agreed to cease and desist from calling Colorado consumers on the No-Call list. The company, Global Financial Mortgage Corporation of Aurora, Colorado, entered into a formal Assurance of Discontinuance and paid a penalty of $2,000 to the State. Since the No-Call law became effective on July 1, 2002, the Attorney General's Office has issued 188 No-Call cease-and-desist notices to commercial telemarketers and obtained six Assurances of Discontinuance with penalties totaling $24,500. The Assurances resolve allegations of continuing violations of the No-Call law after the companies have agreed to comply with the law. During January, the State received 1,348 consumer complaints alleging No-Call violations. Since July 2002, a total of 16,008 No-Call complaints about alleged violations have been filed. The daily average has decreased from 206 complaints per day in the first month of the program to 43 per day in January. Businesses are reminded to update their calling lists to avoid future violations. Consumers may enroll their home phone or fax numbers on the No-Call list by calling toll free 1-888-249-9097 or by going on-line at www.coloradonocall.com. Consumers may file complaints about possible violations of the No-Call law by either calling toll free 1-888-600-5688 or by going on-line at www.coloradonocall.com. The Colorado No-Call law does not apply to calls made to wireless telephones or to business telephone lines. Under the Colorado No-Call law, a state enforcement action may be brought against commercial telemarketers for three or more violations in a month. Consumers may, however, bring private lawsuits in small claims court for a single violation of the law. Consumers may recover a minimum of $500 per violation.
